The law of investment protection and investor-state arbitration proceedings in particular has developed so rapidly and intensely over the last couple of years that it can now definitely be regarded as an area of international law and international arbitration with a distinct character of its own. However, this also means that it is becoming more and more intertwined with other fields of law and the proceedings that are possible and going on there. Investment law can no longer be considered an exotic plant in its private little garden, but has major implications for other legal areas and is itself influenced and shaped by them as well. The panel will – after a concise introduction to the evolution of investment arbitration – explore these mutual ramifications by looking at the relationships between investment law and specifically related areas, namely, international trade law, human rights and international commercial arbitration.

The law of the European Union has seen two developments in 2009 that will have major impacts on the future of international commercial as well as investment arbitration, at least as far as member states of the Union are involved. In the famous West Tankers case, the European Court of Justice has ruled that a court of a member state may not restrain a party from commencing judicial proceedings in another member state by virtue of an arbitration agreement. And in the field of investment law, the Treaty of Lisbon has brought about a decisive shift in competences: According to Article 207 of the new Treaty on the Functioning of the European Union, the conclusion of bilateral investment treaties does no longer fall within the competency realm of the member states, but has become an exclusive competence of the Union. The consequences of these two developments are possibly far-reaching and far from clear. The panel will therefore – from various angles – address the question whether this is just another step of normal progress or whether it changes the scenery altogether.

Both topcis will be introduced with a lecture ("Evolution of Investment Arbitration" by Dr. Sabine Konrad, K&L Gates Paris; "IP and Arbitration" by Dr. Claudia Milbradt, Clifford Chance Düsseldorf) and followed by a panel discussion.

The panel "The Finality of Arbitral Awards in Investment and Commercial Arbitrations: Are Appeals Mechanisms Appealing?" will be moderated by The Honorable Charles N. Brower from Den Haag, the panel "IP and Arbitration: Do the Rules Fit the Game?" by Prof. Dr. Richard Kreindler of Shearman & Sterling in Frankfurt.

Anmeldung / Teilnahme
Man kann sowohl als Einzelperson als auch als Moot Court Team an der Düsseldorf International Arbitration School teilnehmen. Einzelpersonen werden gebeten, der Anmeldung einen Lebenslauf sowie ein Statement of Motivation in englischer Sprache beizufügen. Anmeldeschluss ist der 15. August 2010. Um eine möglichst zeitige Anmeldung, insbesondere für Moot Court Teams, wird gebeten.

Anmeldegebühren
Die Teilnahmegebühr beträgt € 600 für Praktiker, € 300 für Universitätsbeschäftigte und € 150 für Studenten und Referendare. Willem C. Vis International Commercial Arbitration Moot Court Teams erhalten auf Anfrage besondere Stipendien (Gebühr von € 300 für Teams mit bis zu vier Mitgliedern, für jedes weitere Teammitglied fällt eine Gebühr von € 50 an).

Anreise Düsseldorf
Düsseldorf als Landeshauptstadt liegt verkehrsgünstig und kann sowohl per Flugzeug, Bahn und KFZ schnell erreicht werden.

Anreise Universität
Die Universität kann per Straßenbahn, Bus oder Auto erreicht werden. Für die Anreise mit der Straßenbahn wählen Sie eine Verbindung zur Haltestelle "Uni Ost/Botanischer Garten". Für den Bus empfiehlt sich die Haltestelle "Universität Mitte". Von beiden Haltestellen ist das Hörsaalgebäude nur wenige Fußminuten entfernt. Für die Anreise mit dem KFZ stehen im südlichen Teil des Campus genügend Parkplätze zur Verfügung. Hier (pdf-Datei) finden Sie eine Karte des Campus.
Die Veranstaltung wird im Hörsaal 6b Gebäude 26.11 stattfinden. Das Gebäude befindet sich im südlichen Teil des Campus. Falls Sie mit dem Auto anreisen und ein Navigationssystem benutzen geben sie bitte „Christophstraße 96, 40225 Düsseldorf" ein. Dies wird sie direkt zur Juristischen Fakultät führen.

Dress Code
Für die Vorlesungen gilt kein bestimmter Dress Code. Ausnahmen sind der Empfang bei Clifford Chance am Mittwochabend und der Investment & EU Day am Freitag im Industrie Club e.V.  Es empfiehlt sich, zu diesen Terminen im "Business Outfit" (Herren Anzug, Damen Hosenanzug/Kostüm) zu erscheinen.
